These terms govern sales made through the online store www.vulcancymbals.com. They have two parts:
- Part I – General terms (for everyone) and specific rules for Consumers;
- Part II – Terms for Businesses and Retailers (purchases with a VAT number).
Please read them before every order. You can save and print them; the version in force when you order is also emailed to you with the order confirmation.
PART I – GENERAL TERMS AND CONSUMER TERMS
1. Who we are
The seller is ARMAS srl, which makes and sells drum cymbals, drumsticks and accessories under the Vulcan Cymbals brand.
- Registered office: Via Carnazza, 81 – 95030 Tremestieri Etneo (CT) – Italy
- VAT IT05271600875 – Tax code and Companies Register no. 05271600875 – REA CT-354909
- PEC (certified email): armas.srl@pec.it
- Contact form: Contact – Support, returns and warranty: Support
2. Definitions and scope
- Consumer: an individual buying for purposes outside their trade, business, craft or profession (Art. 3 Italian Consumer Code, Legislative Decree 206/2005).
- Business / Retailer: anyone buying in the course of their business, providing a VAT number.
- Customer: both Consumers and Businesses.
- Contract: the distance sales contract concluded through the Site.
Consumers are covered by Part I and, in any case, by the mandatory rules of the Italian Consumer Code, which prevail over any different clause. Purchases with a VAT number are covered by Part II and, unless otherwise stated, by Part I.
The terms published when the order is sent apply. Later changes do not affect orders already placed.
3. Language
The contract may be concluded in Italian or English. If the two versions differ, the Italian one prevails, without prejudice to mandatory consumer protection rules.
4. Products and information
- The main characteristics of each product (model, key, materials, size, EAN code, warnings) are shown on its product page. Photos are representative: colours and details may vary slightly depending on your screen.
- We sell only genuine, new products imported and distributed by us as official distributor. Manufacturer and product safety information is shown on the product page and/or on the packaging.
- Harmonicas and other instruments played with the mouth are marked on the product page as excluded from the right of withdrawal once the sealed packaging is opened (see section 11).
5. Prices
- Prices are in euros and, for Consumers, include VAT. Shipping costs are shown separately in the cart and in the summary before you confirm the order.
- In Italy standard shipping is free for private customers on orders from €300 of products.
- We charge Consumers no fee for using any payment method (Art. 62 Italian Consumer Code).
- When we announce a price reduction, the previous price shown is the lowest price applied in the 30 days before the reduction (Art. 17-bis Italian Consumer Code).
- For deliveries outside the European Union (e.g. Switzerland, United Kingdom, United States, Japan) customs duties, local VAT and fees may be due, payable by the recipient under the rules of the destination country.
- In the event of an obvious and recognisable pricing error (e.g. a clearly negligible price due to a typing error), we will tell you before shipping: you may confirm the order at the correct price or cancel it with a full refund.
6. Account
- You can fill your cart without an account; to complete the purchase you need to sign in or register (email and password). Your account shows orders, invoices, vouchers and support requests.
- Purchases are reserved to persons aged 18 or over.
- You are responsible for keeping your login details confidential. Tell us immediately if you suspect unauthorised use.
7. How the contract is concluded
The technical steps to conclude the contract are:
- choose the products (and, where applicable, the key or variant) and add them to the cart;
- go to checkout and sign in or register;
- enter or check your billing and delivery details (you can request an electronic invoice by entering your tax code or VAT number);
- choose a carrier among those offered, with price and estimated times;
- choose the payment method;
- check the order summary: until this point you can correct any input error by going back to the cart or editing the fields;
- accept these terms by ticking the box and press the “Order with obligation to pay” button.
Sending the order is an offer to buy. The contract is concluded when we send you the order confirmation email, summarising products, prices, shipping costs, payment method and delivery address, with these terms and the withdrawal information and model form attached (durable medium).
The order is stored in our systems and can be viewed under “My orders” in your account.
We may decline an order only for justified reasons (e.g. product no longer available, incomplete or untrue data, suspected fraud, clearly anomalous order): in that case we will tell you and refund any payment without delay.
8. Availability
Stock levels are updated in real time, but errors may occur. If an ordered product is unavailable we will tell you within 2 working days and refund what you paid for it within 14 days; with your agreement we may offer an equivalent product or wait for restocking.
9. Payment
You can pay by:
- Credit and debit cards (Visa, Mastercard, American Express), processed by Stripe Payments Europe Ltd. with your bank’s 3-D Secure authentication. Full card details never reach us and are not stored on the Site;
- PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A.), under PayPal’s terms;
- Klarna – “Pay now” or “Pay in 3” interest-free instalments – provided by Klarna Bank AB (publ), under Klarna’s terms and subject to its assessment; for instalments your creditor is Klarna;
- Amazon Pay (Amazon Payments Europe S.C.A.), under Amazon Pay’s terms;
- Bank transfer in advance to: ARMAS srl – Banco BPM – IBAN IT79 B050 3483 9700 0000 0002 124 – reference: order number. If payment is not received within 7 days of the order, the order may be cancelled.
Card, PayPal and Klarna payments are charged (or authorised) when you order. With bank transfer we ship as soon as the payment reaches our account.
We issue an electronic invoice if you request it when ordering by entering your tax code or VAT number.
10. Shipping and delivery
- We ship through Packlink PRO, which compares the main carriers (e.g. BRT, GLS, Poste Delivery, UPS, DHL, FedEx). At checkout you see the carriers available for your address and cart weight, with price and estimated times, and you choose.
- We deliver to the countries listed at checkout.
- Orders paid by 1 pm on working days are normally dispatched the same or the next working day. Delivery times are carrier estimates. In any case we deliver within 30 days of the contract, unless otherwise agreed (Art. 61 Italian Consumer Code); if we are late you have the rights provided by that article.
- The risk of loss or damage passes to the Consumer only when they, or a person they designate other than the carrier, take physical possession of the goods (Art. 63 Italian Consumer Code).
- We recommend checking the parcel on delivery and, if the packaging is visibly damaged, accepting it “with reservation” and telling us within 48 hours with photos: this helps us handle the claim with the carrier. It does not limit your warranty rights in any way.
11. Right of withdrawal (Consumers only)
You have 14 days from delivery to withdraw from the contract without giving any reason. You can do so:
- online, with the “Withdraw from contract here” function in your account (“My orders”) and on the Withdraw from contract page, available throughout the withdrawal period; you immediately receive an email confirmation with date and time;
- or by sending us a clear statement or the model withdrawal form by email, PEC or post.
Deadlines, procedure, return costs and refunds are described on the Right of withdrawal page, which forms part of these terms.
12. Legal guarantee of conformity (Consumers)
All products are covered by the legal guarantee of conformity (Arts. 128 ff. Italian Consumer Code): we are liable for any lack of conformity that becomes apparent within 2 years of delivery. Details on the Legal guarantee page.
Our technical service as official distributor (diagnosis, genuine spare parts, repairs) is in addition to the legal guarantee and does not limit it.
13. Reviews
Only customers who bought the product on this Site with their account can write a review: the system checks the purchase before publication. We publish both positive and negative reviews; we remove them only if offensive, unlawful, unrelated to the product or containing third parties’ personal data. We do not pay or reward reviews. About one day after purchase we may email you asking for your opinion: you can opt out of these emails at any time.
14. Discount codes and “Share and save” vouchers
Discount codes are entered in the cart. Only one code per order; codes do not apply to shipping or retailer prices and cannot be exchanged for cash. The 10% share voucher programme is governed by the “Share and save” rules.
15. Intellectual property
Texts, photos, graphics and content of the Site belong to ARMAS srl or their respective owners and may not be reused without written permission. Vulcan Cymbals is a trademark of ARMAS srl; other trademarks mentioned belong to their respective owners.
16. Personal data
We process your data as described in the Privacy policy and Cookie policy.
17. Complaints and dispute resolution
- For any complaint use the contact form or write by post to our registered office: we reply within 2 working days and in any case within 15 days.
- ARMAS srl does not currently adhere to any alternative dispute resolution (ADR) body. Consumers remain free to use the ADR bodies provided for by Arts. 141 ff. of the Italian Consumer Code or to go to court.
- The European ODR platform for online dispute resolution was closed on 20 July 2025 (Regulation (EU) 2024/3228) and is no longer available.
18. Governing law and jurisdiction (Consumers)
The contract is governed by Italian law. If you live in another country, the mandatory consumer protection rules of your country of habitual residence still apply (Art. 6 Regulation (EC) 593/2008). For disputes with Consumers resident in Italy, the court of the Consumer’s place of residence or domicile has jurisdiction (Art. 66-bis Italian Consumer Code); Consumers resident in another EU country may sue in the courts of their country and may only be sued there (Art. 18 Regulation (EU) 1215/2012).
PART II – TERMS FOR BUSINESSES AND RETAILERS
This part applies only to purchases made with a VAT number for business purposes. Part I applies for anything not covered here, except sections 11, 12 and 18 which are reserved to Consumers.
B1. Retailer account
- To access retailer prices you must register as a retailer, providing company name, VAT number, SDI code and/or PEC and a recent company registration extract (not older than 6 months).
- ARMAS srl assesses the request and may accept or decline it; you are informed by email. Until approval you cannot order with the retailer account.
- ARMAS srl may suspend or revoke the retailer account in case of untrue data, non-payment or misuse, with notice.
B2. Prices and commercial terms
- Retailer prices are the public price less 30%; Omnichord and Hammond products are sold at net price with no further discount. Retailer prices are shown including VAT, like all prices on the site; the invoice shows net amount and VAT.
- Discount codes, vouchers and free shipping for private customers do not apply to retailer purchases.
- Prices may change at any time; the price shown when ordering applies.
- For sales to VAT-registered businesses in other EU countries, the invoice is issued without Italian VAT (reverse charge) only if the VAT number is valid in the VIES system.
B3. Payment
- Payment is in advance, by the methods listed in section 9, unless otherwise agreed in writing.
- PayPal payments by retailers carry a fee of 3.4% + €0.35, shown before the order is confirmed.
- Orders not paid within 7 days may be cancelled.
B4. Delivery, risk and inspection
- Risk passes to the Retailer when the goods are handed to the carrier (Art. 1510 Italian Civil Code).
- The Retailer must inspect the goods on receipt and report transport damage and quantity differences within 8 days of delivery, with photos and the order reference; visible damage to the packaging must be noted by accepting the goods “with reservation”.
B5. No right of withdrawal
The consumer right of withdrawal does not apply to Businesses. Returns are accepted only for defects (B6) or with ARMAS srl’s prior written agreement, on the agreed terms.
B6. Warranty for defects
- Arts. 1490 ff. of the Italian Civil Code apply. Defects must be reported within 8 days of discovery; claims expire 1 year after delivery (Art. 1495 Civil Code).
- If a defect is confirmed, ARMAS srl will repair or replace the product at its choice, without prejudice to the statutory rights to a price reduction or termination.
- Except for wilful misconduct or gross negligence (Art. 1229 Civil Code), ARMAS srl is not liable for indirect or consequential damage such as loss of profit or customers.
- The final seller’s right of recourse against ARMAS srl under Art. 134 Italian Consumer Code is unaffected.
B7. Images and texts
Approved Retailers may use photos and descriptions published on the Site only to promote products bought from ARMAS srl, without altering them. This permission may be revoked.
B8. Governing law and jurisdiction
The contract is governed by Italian law, excluding the Vienna Convention of 11 April 1980 on the International Sale of Goods. The Court of Catania (Italy) has exclusive jurisdiction.
B9. Specific approval
Under Arts. 1341 and 1342 Italian Civil Code, when registering as a retailer the Business specifically approves the following clauses: B1.3, B2.3, B3.3, B4, B5, B6.2, B6.3 and B8.
